1. Overview and Acceptance

  • By visiting Capital Waterports and purchasing from us, you engage in our "Service" and agree to be bound by the following terms and conditions.

  • You must be at least the age of majority in your state or province of residence to purchase a vessel from this site.

2. Product Accuracy and Pricing

  • We make every effort to display the colors, specifications, and features of our boats as accurately as possible. However, we cannot guarantee that your computer monitor's display will be completely accurate.

  • Pricing for marine vessels and freight is subject to change without notice. We reserve the right to modify or discontinue any product at any time.

  • In the event a boat is listed at an incorrect price due to a typographical error or error in pricing from our suppliers, we reserve the right to refuse or cancel any orders placed for that vessel.

3. Ordering, Payments, and Fraud Prevention

  • We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household, or per order.

  • Due to the high-ticket nature of our inventory, orders may be subject to additional verification, including requests for government-issued identification or proof of address before the vessel is released for freight.

4. Shipping, Freight, and Risk of Loss

  • Delivery dates are estimates and are not guaranteed. Freight transit times for boats depend on specialized carriers and weather conditions.

  • Risk of Loss: The risk of loss and title for the vessel pass to you upon delivery and your signature on the carrier's Bill of Lading (BOL).

  • It is your responsibility to thoroughly inspect the boat for transit damage before signing the BOL. Any damage must be explicitly noted on the delivery paperwork before the driver leaves.

5. Warranties and Limitation of Liability

  • Manufacturer Warranties: Most new boats are covered by a manufacturer's warranty. Capital Waterports acts as a retailer and makes no independent warranties, express or implied, regarding the vessels, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

  • Inherent Risks: The operation of a marine vessel involves inherent risks. Capital Waterports shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use, operation, or inability to use the boat.

  • It is the buyer's sole responsibility to ensure the vessel is legally registered, titled, and operated in accordance with all local, state, and federal maritime laws.

6. Governing Law

  • These Terms of Service shall be governed by and construed in accordance with Canadian law, without regard to its conflict of law provisions.
